(b) Has been guilty of fraud, misrepresentation, concealment, false promises, false pretenses, dishonest conduct, culpable negligence, or breach of belief in any business transaction in this state or another state, nation, or territory; has violated a duty imposed upon him or her by regulation or by the phrases of a contract, whether written, oral, specific, or implied, in an appraisal assignment; has aided, assisted, or conspired with any other individual engaged in any such misconduct and in furtherance thereof; or has shaped an intent, design, or scheme to have interaction in such misconduct and committed an overt act in furtherance of such intent, design, or scheme.
(1) Notwithstanding the prelicensure necessities set forth below ss. 475.17(2) and (6) and 475.one hundred seventy five, the commission in its discretion could enter into written agreements with related licensing authorities of other states, territories, or jurisdictions of the United States or international nationwide jurisdictions to ensure for Florida licensees nonresident licensure opportunities corresponding to these afforded to nonresidents by this section.
(2) A registered trainee appraiser or licensed or certified appraiser might not signal any appraisal report or certification or communicate similar without disclosing in writing that she or he is a state-registered trainee appraiser or state-licensed, state-licensed residential, or state-certified normal appraiser, as applicable, even when the appraisal performed is exterior of the scope of the appraiser’s registration, licensure, or certification as an appraiser.
(i) A broker or gross sales affiliate might not place, or trigger to be positioned, upon the general public records of any county, any contract, task, deed, will, mortgage, affidavit, or different writing which purports to affect the title of, or encumber, any real property if the same is known to her or him to be false, void, or not authorized to be positioned of report, or not executed within the kind entitling it to be recorded, or the execution or recording whereof has not been authorized by the proprietor of the property, maliciously or for the aim of amassing a commission, or to coerce the cost of cash to the dealer or sales affiliate or other person, or for any illegal purpose.
